CBI need no approval of Centre for inquiry against public servant: SC

SUPREME COURT (2)New Delhi: Supreme Court on Tuesday said that the approval of government is not required to Central Bureau of Investigation for launch of inquiry against a public servant in a court-monitored investigation.

A bench of three judges headed by Justice RM Lodha answered on a question that whether central government’s prior sanction under section 6A of the Delhi Special Police Establishment Act was necessary before public servant could be proceed against, the bench said that no such government nod was necessary.

In one of the application filed in coal block allocation scam, the bench passed the order seeking its direction to do away with the provisions of prior sanction of the Centre in cases monitored by court.

The bench said, “Sanction is not necessary under section 6A of the Delhi Special Police Establishment (DSPE) act when the case under the case under the Prevention of Corruption Act is monitored by court.”
