SC rejects PIL over Leader of Opposition issueNew Delhi: The Supreme Court on Friday rejected a plea that the Congress party be given the Leader of Opposition post in the Lok Sabha.

“We are not here to decide political issues in PIL,” said the apex court while hearing the Public Interest Litigation (PIL).

The court stated that ruling of the Speaker of Lok Sabha is not amenable to judicial review.

Notify that Congress had secured only 44 seats in Lok Sabha election 2014 which are less than 10 percent of total seats.

Attorney general Mukul Rohatgi last month told Speaker Sumitra Mahajan the Congress is not eligible for the post of Leader of the Opposition in Lok Sabha as it does not have the requisite strength (10% of total seats).

The PIL had contended that the Congress leader in Lok Sabha be conferred the status of the LoP as it is the largest party in the opposition as provided under the 1977 law on salary and allowances of Leaders of Opposition in Parliament.
