Govt. official must vacate the accommodation within a month after retirement- SC

New Delhi: Supreme Court on Friday expressed concern over MPs, ministers and bureaucrats illegally overstaying in their official accommodation and said that they must vacate the premises within a month after demitting office.

A bench of Justices P Sathasivam and Ranjan Gogoi issued guidelines giving timeframe for vacating government accommodation by judges and government employees upon their retirement or seizing to occupy the office. This also applies to members of Parliament.

The apex court verdict to vacate government accommodation within one month after the retirement of judges and government employee would do so within 15 days of their retirement. This time period can be extended for next one month also in special circumstance.

It said that in case of MPs, Speaker of Lok Sabha and Chairman of Rajya Sabha should initiate proceedings against them for breach of privilege. The bench said, “It is unfortunate that MPs and ministers continue to remain in official accommodation beyond their entitlement.”

The bench said that a notice of three months should be given to the officials before they are supposed to vacate the premises and reasonable force can be applied against them if they refuse to leave the accommodation.
