SC: Registration of FIR in cognizable offences is mandatory

SUPREME COURT (2)New Delhi: Registration of an FIR in cognizable offences is mandatory, ruled the Supreme Court on Tuesday. Clarifying that no preliminary inquiry by a police official is permissible as a condition for registering FIR in cognizable offences, the court ruled that action can be taken against officers for not doing the same. Police officials can’t avoid registration of FIR and action must be taken against them for not lodging FIR in cognizable offences, the apex court said.

The ruling came on a petition filed seeking clarity on the process of police investigations. Police must register FIR in cognizable offences: SC “Police officials can’t avoid registration of FIR and action must be taken against them for not lodging FIR,” the apex court said. The petitioner asked whether the FIR should be registered first when a complaint is lodged, or whether investigations should be conducted to prove the case is valid, before the same is done.
