KM Joseph’s transfer comes at the time when the matter is being heard in the Supreme Court and has raised eyebrows in certain sections.
Justice KM Joseph had made a mark with his observations about the President and the central government during the hearings on Rawat’s petition challenging the President’s rule.
During the court hearings, he was critical of the fact whether the principles of natural justice had been used while implementing Article 356 in the state. He had rapped attorney general Mukul Rohtagi for his pleas saying the imposition of the central rule was justified as the constitutional machinery had failed and there was some possibility of anarchy.
Justice KM Joseph had asked several questions of both sides over the justification and non-justification and wrote the 99-page judgement after 42 hours of hearing that were conducted between March 30 and April 20. In the judgement, the court had quashed President’s rule and asked for the conduction of a floor test on April 29.
The apex court later stayed the decision.
