Lucknow: The chargesheet of Uttar Pradesh police against chief of Bharatiya Janata Party (BJP) Amit Shah had been rejected by a local court in Muzaffarnagar. UP police had alleged Amit Shah for hate speech which he made while campaigning for Lok Sabha elections in UP west.
Court had also made some adverse remark over the manner in which chargesheet was filed by the police. It asked the police to conduct thorough probe.
Senior police officers, however, said the court has returned the chargesheet on mere technical grounds and wanted to know how it was filed.
Senior police official of Muzaffarnagar said, “The court just highlighted some technical aspects of the process of filing the charegsheet. We are studying the judges comment.”
The Muzaffarnagar police had filed a chargesheet in the local court on Wednesday, booking the BJP president for allegedly seeking votes on the grounds of religion, race, caste and community. Filing of the chargesheet came after the Election Commission had directed the Muzaffarnagar administration to register an FIR against the BJP leader for alleged hate speech and “violation” of model code of conduct during the Lok Sabha poll campaign.
UP police in his chargesheet booked Amit Shah under various sections of IPC, including 153A (promoting enmity between different groups on grounds of religion, race, place of birth, etc.), 295A (deliberate and malicious acts, intended to outrage religious feelings of any class) and 505 (false statement, rumour, etc. circulated with intent to cause mutiny or offence against the public peace), and Section 123-3 of Representation of People Act (making an appeal to vote on the grounds of religion amounting to corrupt practice) on Wednesday.
