SC says no promotion for cops behind fake encounters, issues strict guidelinesNew Delhi: the Supreme Court today issued binding guidelines on police encounters which mandates filing of FIR in all such cases. As per the apex court directive, if an encounter leads to a death, FIR must be filed and a magisterial probe under Section 176 of Criminal Procedure Code carried out.

The probe is handled by the state CID or a separate police station, the court added. Every intelligence input or tip-off about movement of armed criminals or terrorists must be recorded in writing by the police party before proceeding to nab them.

They will also have to surrender weapons and ammunition after the encounter. The court verdict also bars awarding of gallantry awards or promotion to policemen involved in encounters until the probe gets over.

As per Surat Singh, the petitioner in the case, SC has come out with extensive guidelines on fake encounters which will be treated as law under Section 144.
